Εκατοντάδες ακαδημαϊκοί και συγγραφείς προς Ε.Ε. για την πολυετή κυβερνητική καταδίωξη της The Athens Review of Books

[Έκκληση προς τους επικεφαλής της Ε.Ε. απευθύνουν εκατοντάδες ακαδημαϊκοί και συγγραφείς προκειμένου να σταματήσει η πολυετής κυβερνητική καταδίωξη της The Athens Review of Books]

Το περιοδικό ARB, το ελληνικό αντίστοιχο του New York Review of Books, δημοσίευσε επιστολή αναγνώστη που αναφερόταν στο πολιτικό παρελθόν του μέχρι πρότινος Έλληνα Υπουργού Εξωτερικών Ν. Κοτζιά ως στελέχους του ΚΚΕ, χαρακτηρίζοντάς τον φανατικό σταλινικό («γκαουλάιτερ του σταλινισμού»). Ο Ν. Κοτζιάς (συγγραφέας βιβλίων με τα οποία υμνούσε το ολοκληρωτικό καθεστώς Χόνεκερ και τη δικτατορία Γιαρουζέλσκι) άσκησε αγωγή κατά του περιοδικού ζητώντας αποζημίωση 250.000 ευρώ.

Δικαστικές αποφάσεις θεώρησαν ως συκοφαντικό τον χαρακτηρισμό «ακραίος σταλινικός», παραβλέποντας ότι είναι αξιολογική πολιτική κρίση για ένα δημόσιο πρόσωπο. Υπάρχουν ενδείξεις ότι ο υπουργός και η κυβέρνηση επενέβησαν στην λειτουργία της Δικαιοσύνης προκειμένου να ευοδωθεί η δίωξη κατά του περιοδικού. Μία από τις ισχυρότερες είναι ότι στον Άρειο Πάγο, ανώτατο Δικαστήριο της χώρας, η εισηγήτρια της υπόθεσης πρότεινε να γίνει δεκτή η αναίρεση της ARB, διότι παραβιάστηκε η νομολογία του Ευρωπαϊκού Δικαστηρίου Δικαιωμάτων του Ανθρώπου και το Ελληνικό Σύνταγμα, αλλά η ίδια αργότερα καταψήφισε, χωρίς καμιά αιτιολογία, την τεκμηριωμένη γραπτή εισήγησή της και εν συνεχεία επελέγη από την κυβέρνηση Αντιπρόεδρος του Αρείου Πάγου.

Από τον Ιούλιο του 2017 ο Υπουργός Εξωτερικών έχει δεσμεύσει τους λογαριασμούς της εκδότριας και του διευθυντή της ARB και τα έσοδα του περιοδικού από το Πρακτορείο Διανομής Τύπου, με προφανή στόχο το κλείσιμό του.

Η μεθόδευση της πολυετούς εξοντωτικής δίωξης της ARB αποτελεί ακραία κατάχρηση της δυνατότητας που δίνει ο ελληνικός νόμος στους πολιτικούς να ασκούν αγωγές για αποζημίωση κατά εντύπων ζητώντας υπέρογκα ποσά. Και μάλιστα να τις κερδίζουν, παρά την νομολογία του Ευρωπαϊκού Δικαστηρίου Δικαιωμάτων του Ανθρώπου, εκφοβίζοντας έτσι τον Τύπο και αποτρέποντας την άσκηση πολιτικής κριτικής. Περίπτωση τόσο παράλογης και τόσο απηνούς καταδίωξης όσο αυτής του (πρώην) Υπουργού Εξωτερικών εναντίον της ARB δεν έχουμε γνωρίσει τις τελευταίες δεκαετίες στην Ευρωπαϊκή Ένωση. Πρόσφατα κατατέθηκαν στο Ευρωπαϊκό Κοινοβούλιο τρεις διαφορετικές ερωτήσεις Ελλήνων ευρωβουλευτών προς την Επιτροπή σχετικά με την δίωξη της ARB, ενώ ο αρχηγός της αξιωματικής αντιπολίτευσης δήλωσε ότι «η καταδίωξη της Athens Review of Books είναι ντροπή για την Ελληνική Δημοκρατία». Μάλιστα, ο πρώην Υπουργός ομολόγησε δημοσίως ότι «εθήτευσα στη σταλινική αριστερά» (23.10.2018), πράγμα που στην αγωγή του θεωρούσε συκοφαντικό και το οποίο δέχθηκαν τα δικαστήρια!

Για το ζήτημα έστειλε επιστολή προς τον Ζαν Κλωντ Γιούνκερ, πρόεδρο της Κομισιόν, και τον Ντόναλντ Τουσκ, πρόεδρο του Ευρωπαϊκού Συμβουλίου, η Αμερικανική Εταιρεία Πολιτικής Επιστήμης (American Political Science Association), μια επιστημονική εταιρεία που εκπροσωπεί πάνω από 11.000 καθηγητές και φοιτητές πολιτικής επιστήμης στην Αμερική και διεθνώς, μεταξύ των οποίων και πολιτικούς επιστήμονες στην Ελλάδα.

«Σας γράφουμε για να σας εκφράσουμε τη βαθιά ανησυχία μας για την απειλή που δέχεται η ακαδημαϊκή και πολιτική έκφραση στην Ελλάδα. Όπως γνωρίζετε, τα ελληνικά δικαστήρια έχουν δικαιώσει προσπάθειες για να περιοριστεί η δυνατότητα της Athens Review of Books (ARB) να παραμείνει κορυφαίος χώρος διαλόγου για σημαντικά πολιτικά ζητήματα. Πληροφορηθήκαμε ότι ο πρώην Υπουργός Εξωτερικών κ. Νίκος Κοτζιάς έχει δεσμεύσει τους τραπεζικούς λογαριασμούς της εκδότριας του περιοδικού και έχει προβεί σε εκτεταμένη δικαστική δράση εναντίον της ARB ως απάντηση σε μια επιστολή αναγνώστη, η οποία ασκούσε κριτική στον Υπουργό Εξωτερικών.

Η APSA συμμερίζεται την άποψη πολλών διαπρεπών ακαδημαϊκών ότι οι ευρωπαϊκοί θεσμοί πρέπει να επαγρυπνούν για να προστατεύουν ισχυρές ελευθερίες της ακαδημαϊκής και πολιτικής έκφρασης ενάντια σε κάθε κυβερνητική καταστολή. Το Άρθρο 11 του Χάρτη των Θεμελιωδών Δικαιωμάτων και το Άρθρο 10 της Ευρωπαϊκής Σύμβασης για την Προάσπιση των Δικαιωμάτων του Ανθρώπου και των Θεμελιωδών Ελευθεριών επιβεβαίωσαν την δέσμευση της Ευρωπαϊκής Ένωσης για ελεύθερη έκφραση χωρίς κυβερνητικές παρεμβάσεις. Ζητάμε να συνεργαστείτε με την ελληνική κυβέρνηση ώστε να διασφαλίσετε ότι η μεταχείριση της ARB θα είναι σύμφωνη με το πνεύμα των ανωτέρω δεσμεύσεων», επισημαίνεται στην επιστολή.

Οι προσωπικότητες από την Ευρώπη που ζητούν από τον Πρόεδρο της Ευρωπαϊκής Επιτροπής και τον Πρόεδρο του Ευρωπαϊκού Συμβουλίου να εξαντλήσουν όλα τα μέσα που διαθέτει η Επιτροπή και το Συμβούλιο για να σώσουν ένα έντυπο που τιμά τα ελληνικά γράμματα και τον ελληνικό Τύπο, είναι οι εξής:

    Και όταν ο Βασιλάκης δικαιωθεί στο ΕΔΔΑ (Ευρωπαϊκό Δικαστήριο Δικαιωμάτων Ανθρώπου), την αποζημίωση ΔΕΝ θα τού την καταβάλουν ούτε οι Δικαστές που εξέδωσαν αυτές τις άδικες (σύμφωνα πάντα με το ΕΔΔΑ) Αποφάσεις ούτε ο Κοτζιάς· θα τού την καταβάλει το ελληνικό δημόσιο, δηλ. … ημείς οι φορολογούμενοι!
